The new hit-and-run rule under India’s Bharatiya Nyaya Sanhita (BNS), Section 106(2), imposes strict penalties to prevent drivers from escaping accident scenes. If a driver causes a fatal accident through rash and negligent driving and flees the spot without reporting it to a police officer or magistrate, they can face up to 10 years in prison and a heavy fine. However, if the driver stops, assists the victim, and informs the authorities immediately, they fall under Section 106(1), which carries a significantly lower maximum punishment of up to 5 years. The law aims to reduce hit-and-run fatalities.
